Another interesting county commission meeting took place today in Butte County, which included the commission possibly committing multiple open meetings violations, using variances to allow marijuana businesses to operate outside of the ordinances they were approved under, allowing marijuana owners to jeer at and mock citizens while speaking while violating first amendment rights and removing a tax paying citizen during public comment. This all comes after the county commission adopted strict policies for public comment, which included moving it to the end of the meetings, cutting speaking time from 5 minutes to 3 minutes, not allowing citizens to speak about anything beyond agenda items, and not engaging citizens during this time. However, these rules are violated by the commissioners themselves as quickly as they adopted them, as they seem to pick and choose what and when they’ll enforce said policies. Also to note is the lack of action by the Butte County State’s Attorney, LeEllen McCartney, when the commission clearly violates various state laws, their policies, the Constitution and ethics. Sadly, she remains silent and our Sheriff does only as the commission directs. On top of that, Commissioner Erk, despite being a loner when it comes to wanting to truly represent his constituents, will vote accordingly every time.
In an interesting twist, SD Canvassing happened to be watching the live video of the meeting and saw Travis Ismay get removed by the county commission, headed up by James Ager. Within a matter of an hour, maybe two, Travis found himself being interviewed by The Lindell Report, complete with showing the footage of the meeting where James Ager had him removed, thanks to SD Canvassing calling the Lindell Report and telling them what happened. Item 7 of the County Commission’s “Meeting Protocol and Rules of Decorum Policy” clearly states that “The Chairman or Commissioners will not
enter a dialogue with citizens.”. They actually did enter a dialogue with Travis.
I fail to see any “. . . acting in a disorderly manner . . .” (Item 10 of the Rules of Decorum) in Travis’ question. This is a free speech issue – just because the commissioners take offense at a question is no justification for violation of their own rules!
